1990年，美国修改了1963年《清洁空气法》。根据该法，在美国销售的所有汽油分为精炼和常规两大类。凡是被认定空气污染最严重的一些美国大城市地区和未达到美国***空气洁净标准，且由所在州州长要求列为空气污染最严重的其他地区，均不得销售常规汽油，而只能销售精炼汽油。为此，《洁净空气法》要求确保汽油燃烧中的污染不超过1990年的水平，该新法案适用于美国的炼油商、加工商和国外炼油商，并授权给美国环境保护局执行。环境保护局于1993年12月15日制定发布了《燃料与燃料添加剂规则：精炼汽油和常规汽油标准》。
为了实现排放要求，必须首先确定1990年的汽油质量基准，作为此后衡量精炼汽油和常规汽油的标准。为此，环保局确定了两种基准：一种是企业单独基准，以该企业1990年经营的汽油的质量数据确定，其质量数据由企业自己提供；一种是法定基准，以1990年***汽油平均质量确定。
新汽油标准规定：（1）对1990年经营6个月以上的***炼油商适用企业单独基准。（2）对新开设的或在1990年经营不足6个月的企业，以及环保署认为那些无法提供足够的或可信数据的企业，则适用法定基准。（3）如果某进口商同时是国外炼油商，当它1990年进口到美国的汽油数量中有75%来自其在国外的炼油厂，则使用与***炼油商同样的方法确定基准（即75%规则）。（4）混合加工商或进口商如果无法使用第一种方法确定基准，则必须适用法定基准。（5）外国炼油商一律适用法定基准。
