儒家独尊地位确立之后，整个封建王朝时代它都不曾动摇过，而在近现代社会转型和当代社会动荡时期，它却遭到了不公正的诋毁，之所以这样，与其学说思想当然脱不了干系，其中还包括时代因素的影响。身为儒家生力军的孟子，其学说曾倍受推崇，围绕其提出的“仁”之学说，学界的探讨相当之多，这些论说精辟也不失公平、客观，但亦有以偏概全和溢美之嫌，时代的发展给我们反思孟子学说和这些观点提供了新的视角。 一、“仁”之始末和概念辨析 最先阐释“仁”的并非孟子，儒家开派始祖孔子对“仁”就有不少宏论。“仁”在孔子时代仅构成一孤立概念，“如有王者，必世而后仁”，“人而不仁，如礼何？人而不仁，如乐何”〔1〕，诸如此类，皆以一“仁”字抒发其思想，很少另用它字与之匹配，这点从下面的引文也能看出。 孔子之“仁”内容极其宽泛，多为个人品德（品性）修养问题。《论语》开篇《学而》即有“君子务本，本立而道生，孝悌也者，其为仁之本与”，似乎“仁”之根本在于“孝悌”，此说即便有不当之处，但孔子对“仁”的论述不少是由此而阐发开的。同章又言“巧言令色，鲜矣仁”〔2〕，“弟子入则孝，出则悌，谨而信，泛爱众，而亲仁”，从以上言论可以看出，“仁”在孔子的眼中是一个如何做人——修身（齐家、治国、平天下的前提条件）的问题，与《大学》一再言及的“身修而后家齐，家齐而后国治，国治而后天下平，自天子以至于庶人，一是皆以修身为本”有相契合之处〔3〕。 孔子这一思想尤其凸显在回答“仁”为何物问题上，其弟子就“仁”曾多次提问，但孔子的答案从不相同。颜渊问仁，子曰：“克已复礼为仁，一日克已复礼，天下归仁焉，为仁由已，而由人乎哉？”颜渊随而问具体做法，孔子说“非礼勿视，非礼勿听，非礼勿言，非礼勿动”，这是孔子对“仁”的一种解释，就颜回本人而言，“仁”就在于“依礼行事”，步骤如何孔子说得一清二楚，所以颜回马上回答说“回虽不敏，请事斯语矣”〔4〕。显而易见，这里的“仁”是个人品性问题，而不是一个社会问题，它强调的是个人行为准则，即修身问题〔5〕。樊迟曾三次问“仁”，孔子在《颜渊》中曰“爱人”；《雍也》中云“仁者先难而后获，可谓仁矣”；《子路》中说“居处恭，执事敬，与人忠，虽之夷狄，不可弃也”。可见“仁”之意义因时而异，虽然三次回答各不相一，但其主旨却还是告诉樊迟做人的道理，即如何达“仁”。孔子曾云“志于道，据于德，依于仁，游于艺”，又曰“刚、毅，木、讷，近仁”，又说“能行五者于天下，为仁矣”，即“恭，宽，信，敏，惠”〔6〕，这里仁与道、德、艺、恭、宽、信、敏、惠是同等的，而这些在孔子的言论中都是个人修身目标。 谁能做到“仁”的要求，便可称为“仁者”，所以孔子对“仁”的解释还有“仁人”的意思，“微子去之，箕子为之奴，比干谏而死”，孔子曰“殷有三仁焉”；“知者乐水，仁者乐山，知者动，仁者静，知者乐，仁者寿”〔7〕，这一点似乎用不着多举例。“仁”的难易如何？对孔子而言，“仁”似乎轻而易举，“仁远乎哉？我欲仁，斯仁至矣”〔8〕。实际情况如何呢？《公冶长》中记有孟伯武问孔子子路、求、赤是否做到了仁？孔子回答“不知道”，随即解释说“由（子路）也，千乘之国，可使治其赋也，不知其仁也；求也，知室之邑、百乘之家，可使为之宰也，不知其仁也；赤也，束带立于朝，可使与宾客言也，不知其仁也”，可见并非易事。 孟子对“仁”的论述远没有孔子繁杂，单独使用“仁”的情况很少，更多的是用“仁义”、“仁政”、“仁术”之语，“仁”成了一个修饰名词，其主体意思也似乎发生了转移。经过孟子的发挥后，“仁”的含义有了明确指向，可以更具体地理解它，也能加以总结和概括了，这就是学者为什么对“孟子仁学”谈得更多的原因，也是将其“仁”多局限于“仁政”的缘故。 其实孟子之“仁”，仅“仁政学说”是不能加以概括的，它有狭义和广义之分。狭义上的“仁”即学者们所言的“仁政学说”，广义上的“仁”还有“仁人”、“个人修身”其它意思，这也是孟子对孔子学说继承的地方。就后者而言，在孟子的论述中占有一定比重，“焉有仁人在位，罔民而可为也”〔9〕；这是孟子对“仁人”的厚望，“惟仁者为能以大事小，是故汤事葛，文王事昆夷”〔10〕，这是孟子对“仁人”的崇仰，对孔孟而言，仁者是无敌的。“仁，人心也”，“君子所性，仁、义、礼、智根于心”〔11〕，这又强调了个人的修养问题，“仁义”即是孟子一再言及的个人行为准则。“仁之实，事亲是也”，“尧、舜之道，孝悌而已矣”，而尧、舜“不以仁政，不能平治天下”〔12〕，显然这是对孔子所言“孝悌也者，其为仁之本”的认可与赞成。孟子对孔子的承袭之处尚多，此不多赘。 如果孟子仅继承而闭门造车，其影响是不会有这么大的，他没有将“仁”僵化，而将它用之于政治，即而产生了狭义上的“仁政学说”，这是学者们一再发表论说的地方〔13〕，也是我要重点讨论的问题。 二、“仁政”学说的反思 “仁政学说”是孟子政治思想的主体，不仅有完整的体系，而且在当时还有实践的可能。有学者认为其“仁政”的哲学理论基础是“性善论”，“仁政”是合乎人性的，和人与生俱来的善性是分不开的〔14〕。这一结论能否成立，不置可否，但有质疑之处，荀子虽持“性恶论”，但他对“仁政”并不完全持反对意见，况且人性数千年而不变，但政治却无时无刻不在变。人性如何与政治理念能否拉上关系且待论证，如果仁政是“性善”的结果，那么它肯定是空中楼阁，仅被当作一种理想而已。 孟子“仁政学说”体系完整不是表现在它的哲学理论基础，孟子至少谈到过它的经济和政治（现实）基础。前者即井田制，《滕文公上》对此有详细记载，滕文公使毕战问孟子关于“井田”之事，孟子云“子之君将行仁政，夫仁政，必处经界始，经界既正，分田制禄，可坐而定也，请野九一而助，国中什一使自赋，卿以下必有圭田，圭田五十亩，余夫二十五亩，方里而井，井九百亩，其中为公田，八家皆私百亩”，此其大略。具体细节还有“五亩之宅，树墙下以桑，匹妇蚕之，则老者足以衣帛矣，五母鸡，二母彘，无失其时，老者足以无失肉矣，百亩之田，匹夫耕之，八口之家足以无饥矣”，如此“则仁人以为已归矣”〔15〕，百姓依之如水之就下。“不违农时”乃“王道之始”，“五亩之宅，树之以桑，五十者可以衣帛矣，鸡豚狗彘之畜，无失其时，七十者可以食肉矣，百亩之田，勿夺其时，数口之家可以无饥矣”，这样“七十者衣帛食肉，黎民不饥不寒，然而不王者，未之有矣”〔16〕。井田制的实行，可以得民众，可以招仁人，从而可以实现王政（仁政）。 孟子仁政的政治基础也可说现实基础即民本思想，这一点是学者们谈论的比较多的，此仅稍作补充。孔子体会更多的是“礼乐制度”的崩坏，恢复“周礼”是他解决政治和现实问题的关键与终极目的，历史证明他的努力只是一场闹剧。生产力进步带来的经济和政治制度的变化，在战国时更加剧烈，如何在战争中取胜，在争霸中保国，这才是当时统治者关心的问题，也是诸子立说和亟待解决的问题，“天下恶乎定？定于一”〔17〕，这是诸子百家的共同心愿。孟子憧憬西周的王政，但不能仍停留在孔子的方法上，必须对孔子所言的“郁郁乎文哉，吾从周”的方法与途径加以改进。孔子有“苛政”之说，也要求当权者“使民以时”，也说过“为政以德，譬如北辰，居其所而众星拱之”〔18〕。孟子的“仁政学说”是对孔子“礼乐”追求的扩充，是对孔子“苛政”、“德政”的发展。 孟子“仁政思想”内涵可谓无所不包，有学者曾分三个方面作过总结，经济方面有制民之产、薄其税敛、不违农时发展农业生产、坚持社会分工重视商业，其目的在于富民，有王天下的物质基础；政治方面要求以身行道、宽猛相济、与民同乐、选贤举能，这是仁政的直接成果；教育方面主张礼治德教〔19〕。这一总结基本上将孟子的“仁政思想”概括齐全，此外，孟子强调战争中对被攻占国也要实行“仁政”。孟子“仁政思想”内容虽然很多，涉及面也非常之广，这并不表示其学说高深莫测，相反，孟子认为任何执政者只要愿意，都能实行他所说的“仁政”。梁惠王初见孟子即言何以利其国，孟子对之以“仁义”，后进之以“王道”，即“仁政（王政）”，行此“而不王者未之有也”〔20〕。《滕文公下》载万章担心宋以小国行王政，而“齐、楚恶而伐之”，孟子则对曰：“苟行王政，四海之内皆举首而望之，欲以为君，齐、楚虽大，何畏焉？” 虽然孔子和孟子不遗余力宣传游说，但“德政”与“仁政”在当时的影响极其有限，却给我们留下了许多反思的余地。孔子强调的“礼乐”是时尚有法律职能，而不仅仅是讲求个人的道德修养，“德政”更是要求“礼、刑、德”的综合运用，其规范性也具有明确的指向——西周的太平盛世和周公制礼作乐的社会职能。后来由于封建统治者的需要，“礼乐”的概念和指向逐渐被缩小，其社会功能也逐渐被僵化，如司马迁在《论六家要旨》中论儒家的特点就是如此，重点仅强调儒家的等级制度而不及其余。所以孔子的“礼乐”逐渐失去了即有的法律功能，演为要求人们强制遵守的礼教，开始禁锢人们的思想，尤其是对女子的歧视与束缚，更是对“礼乐”最大的曲解，“礼乐”不再指向社会，而针对个人，一定范围的个人。 孟子的“仁政学说”是由孔子的“德政”提升而来的，在孟子看来实施“仁政”在战争动荡时期能达到“王天下”的目的，当然这一“学说”也没有最终实现。然则何以儒学“仁政思想”又经久不衰？“仁政学说”的道德含义，正是孔孟之学经千年而不灭的原因之一。在一统太平时期实行“仁政”能出现治世，治世在百姓的眼里，即是好皇帝施行仁政的结果，而乱世则是暴君带来的恶果，皇帝的好坏即谁勤于政事，替天下苍生着想，布惠天下，行仁政。在中国整个历史长河中，人治始终占据了重要的地位，而人治的好坏直接表现便是道德的评判标准，孟子的仁学便只是对执政者如何要求，其具体施政内容也多为一些大而化之的东西，没有具体的规范与教条，仁义礼智，虽强调个人的修身，却正好是对个品德的修养，而不是对法律、法治的把握，道德与政治的合二为一，便产生了人治方面的弊端，对官员的执政公平与公正，依法与道德的差别则偏向道德的要求，《云梦秦简》《语书》中曾一再强调“依法”，说明在我国专制早期，曾有一个好的开头，但却没有被继承与发扬，毕竟道德对人性来说，更显眼也更容易让人理解。而这正是孟子仁政学说的后果，虽然不全是孟子的功劳，但其始作蛹却不容回避，法制排除道德上的干扰，而儒学又千方百计把道德作为其一个重要内容，人治很容易以道德为治国的依据，《春秋》决狱本身就是对法律的破坏，对时代的一种静止理解，所以汲黯对汉武帝有“陛下内多欲而外施仁义”的言论，道德的评判有很大的不确定性与掩饰性，法律讲求唯一性和公平性，道德却参与了人的感情与同情，这也是孟子人性善论的基点。 “仁”与政结合便是“仁政”，主体偏向于政治范畴；与礼、义、智结合则是个人修养问题，更多的属于道德范畴，而道德是个人自愿的行为而不具备强制性。德治与仁政，在孔子和孟子看来都是以个人修养为前提的，如果能落在实处，而不流于形式，当然有它的作用。今天治国又何尝不是如此，我们党有一系列的原则、纲领、宗旨，如果这些都能真正贯彻，当然利国利民，而一旦出于形式，便一无足观。
