转载：NVOCC（Non-Vessel Operating Common Carrier） 无船承运人什么是无船承运人?目前，对承运人所下的定义，一般是“与发货人订立运输合同的人或者实际完成运输的人”。国际货运代理人进入运输领域，开展单一方式运输或多式联运业务时，由于与委托人订立运输合同，并签发运输单证（FCT、FBL等），对运输负有责任，因而已经成为承运人。但是，由于他们一般并不拥有或掌握运输工具，只能通过与拥有运输工具的承运人订立运输合同，由他人实际完成运输，这种承运人一般称为无船承运人。无船承运人在实际业务中只是契约承运人，而实际完成运输的承运人是实际承运人。无船承运人的业务范围由于经济、技术实务不同，无论在国内还是在国外，无船承运人经营业务的范围有较大区别，有的无船承运人兼办货物报关、货物交接、短程拖运，货物转运和分拨、订舱及各种不同运输方式代理业务，有的只办理其中的一项或几项业务。但一般来讲，无船承运人的主要业务是：1． 作为承运人与货物托运人订立运输合同，签发货运单据（提单、运单），并对从接受货物地点到目的地交付货物地点的运输负责。2． 作为总承运人组织货物全程运输，制定全程运输计划，并组织各项活动的实施。3． 根据托运人要求及货物的具体情况，与实际承运人洽定运输工具（订舱）。4． 从托运人手中接受货物，组织安排或代办到出口港的运输，订立运输合同（以本人的名义），并把货物交给已订舱的海运承运人。在上述交接过程中，代货主办理报关、检验、理货等手续。5． 如有必要，办理货物储存和出库业务。6． 在目的港从海运承运人手中接受货物后，向收货人交付货物。对于货主来讲，将货物交给无船承运人运输，比交给传统意义上的承运人运输在手续上要简便得多，而且可省去委托货运代理人这一环节。无船承运人的分类根据经营业务范围及性质的不同，无船承运人可分为以下3类：1． 承运人型。这类无船承运人是在自己确定的运输路线上开展运输活动，接受托运人的货物并签发提单，对运输过程中货物的灭失、损害承担责任。在实际业务中，他是契约承运人，并非由自己完成运输，只能将货物交给实际承运人运输，并在目的地接受货物后，向收货人交付货物。2． 转运人型。这类无船承运人专门从事转运，他们在主要的货物中转地和目的地，设有自己的分支机构（办事处）或代理，从托运人或陆上运输承运人手中接受货物，签发提单，然后办理接续运输、中转、发货，将货物交给海上承运人，由海上承运人完成海上运输，在目的港接受货物后，再向收货人交付。该类型与承运人型的主要区别，是它并不限定运输路线，不仅可选择合适的承运人，也可选择最合适的运输路线。目前，许多船公司在揽货方面，对转运无船承运人有较大的依赖性，因此，转运人在为自己揽货，经营转运业务的同时，积极地作为承运人的代理人，代表承运人办理接受、交付货物，装、拆箱，托办、代收运费等业务，并从中获得收益及运费差额。3． 经纪人型。该类无船承运人在揽取不同货主货物后，原则上不直接对货主提供运输服务，而是采用“批发”的方法，按运输方式和流向，成批交给转运人型或承运人型的无船承运人，并由他们签发提单。由于这种做法具有明显的经纪人特点，所以称为经纪人型。无船承运人充当经纪人是近些年来出现的一种运输服务形式，这种类型的无船承运人一般不从事具体经营活动以及实际服务业务，只从事运输的组织、货物的分拨、运输方式和运输路线的选择及服务的改善，而其收入主要是中介费和由于“批发”而产生的运费差额。 Vocc的中文意思是承运人。
