sediments,and then methane hydrates form and precipitate in pore.Free gas migration alters the geological properties of the sediment layer.It is one of the key factors to control hydrate formation in seepage system.According to this kind of flow-transfer-reaction process,a multi-phase flow model including water-gas (free gas)-salt-hydrate has been eatablished.In the order of two different scene (the beginning and the end) ,the relationship alteration of capillary pressure,permeability,phase saturations and salinity with the formation of hydrate have been deducted.Based on the rules drawnfrom the simulation,and combined information gottenfrom drills in field,the methane hydrate(MH)formation in Shenhu area of South China Sea has beenforecasted.It has been speculated that there may breed a moderate methane flux below this seafloor HSZ.If the flux is about 0.5 kg·m-2·a-1,then it will go on to evolve about 2 700 ka until the hydrate saturation in pore will arrive its peak (about 75%).Key 引言甲烷水合物（MH）在全球海域和冻土层广泛存在[1-2]，据估算约有1.2×1017m3甲烷以水合物形式存在海洋里（STP），另有大约1015mol的甲烷以游离或溶解的形式存在于沉积层孔隙中[3-4]。渗漏型水合物储层由于具有分布集中、储藏密度大、成藏与物化条件优越等特点[5]，其资源意义十分重要。在海底多相流体流动区域沉积层孔隙里水合物的形成是一种典型的多相流输运传递过程[6]，除了气（游离气和溶解气）、孔隙水和盐外，已生成的水合物也影响着水合物的进一步继续形成。对于这种多相流过程，Clennell,et al.[7]解释了甲烷气体迁移和聚集对水合物形成的影响；Milkov,et al.[8]分析了ODP1249站位的水合物岩心后，指出在这种体系里水合物、气和盐三相可以共存；数值模拟结果也显示了温度、压力、甲烷体积分数以及盐度等相互间的演变关系[11]。然而，水合物的形成将吸收孔隙内的水和气，直接导致多相流组分的变化；同时，水合物胶结沉积层骨架使得含水合物沉积地层的结构和属性发生改变，这些都必须研究确定。渗漏区域里游离气不仅在水合物稳定区域（hydrate stable zone,HSZ）的底界下大量聚集，而且在HSZ内也快速迁移，提高沉积层孔隙内盐度，进而改变该体系下的地质分层，产生诸如水合物－离气－盐三相共存[12]、海底气体“火焰”[13]等现象；一方面说明游离气参与了水合物形成，另一方面也成为探测水合物成藏的间接证据。我国南海神狐海域地质勘探、实地钻井取样及岩心分析表明，该区域很可能是渗漏类型的水合物储藏[14-18]，本文将结合渗漏类型水合物形成规律分析神狐海域的甲烷水合物储藏状况。1 游离气迁移与相图当富含饱和溶解甲烷的孔隙水夹裹着游离气从游离气区域（free gas zone,FGZ）上移，刺穿HSZ底部并进入HSZ内，溶解甲烷首先在孔隙内生成MH并沉淀，使孔隙水中的甲烷浓度变低，游离甲烷气部分溶解在孔隙水中，部分也同时生成MH，直到当地的孔隙空间内MH浓度达到饱和，底部新进入的流体和游离甲烷则继续上移，重复生成MH。由于盐离子被水合物晶体排斥，在孔隙内MH周围盐离子浓度变大，改变MH生成的热力学相平衡条件，抑制MH的生成，并使得HSZ厚度变少，源源不断供应的游离甲烷气增强了盐离子的这种抑制效应。当原位沉积物孔隙里的MH达到最大饱和度后，系统变稳定，不会再有MH的形成，游离气顺利穿越HSZ抵达海底，渗漏进入并溶解在上部海水里（图1）。一般而言，沉积孔隙中的MH生成是一个两相和三相之间的转化过程：气－水相变为气－水－水合物，最后仍变为气－水相。图1 Cl），或线AI 13.6％盐度），在线GH (FI）右边水合物形成，同时，水合物－游离气－盐共存。2 多相流分析2.1 模型建立对于由气－液－固三相和甲烷－水－盐－水合物4组分组成的多相流系统，做以下假设：1）不考虑组分分子扩散，沉积物孔隙始终被组分完全填充，且为各向同性。2）渗漏气体为单组分甲烷，以游离甲烷和溶解甲烷形式存在，初始溶解甲烷饱和。3）盐仅溶解且始终在孔隙水里，不考虑盐饱和度变化导致的盐结晶析出。根据以上假设，分别建立气、水两相的传输方程：对水，其存在于水合物和液态水里：南海天然气水合物富集规律与开采基础研究专集对甲烷，其存在气相、液相和水合物中：南海天然气水合物富集规律与开采基础研究专集式（1）、 在开始36d和结束3100ka不同时刻里随着游离甲烷的不断进入HSZ内，（A）孔隙里气液间的毛细压力，（B）含水合物沉积层的渗透率，（C）气、水、水合物饱和度，和（D）孔隙盐度的变化过程；在图中HSZ底界处于403m（bsf）处，边界条件见图1当t=36 d时，海底深处的甲烷进入HSZ底部，水合物形成，底部通入的甲烷对HSZ内水合物形成的影响已经达到海底处（图2a C）；由于水合物的形成，气液界面接触面积和张力均发生改变，导致毛细压力也在此段距离上随之变大（图2a A）；同时，沉积层渗透率由于水合物的胶结开始变小（图2a B）；盐离子被排挤使得当地孔隙水盐度变大（图2a D）。当t=3 100 ka时，反应结束，HSZ内MH不会继续生成。从图2b C可以看到，由于限制海底处的Sh为0，此处的水合物饱和度梯度很大，这也说明若模型考虑到海水里的HSZ，则Sh将在这个区域继续生成；此时，海底处最大的Pc可以达到约30 k Pa（图2b A）；而水合物胶结砂土沉积物后渗透率达到约10-20m2，已到达相当致密程度（图2b B）；盐度在HSZ底部边界处达到最大可达约16％（图2b D）。表1 模拟南海神狐海域MH形成采用的相关参数数据2.2.2 甲烷渗漏通量另一个影响水合物形成的重要参数是甲烷渗流通量qm(kg/m2），不同的渗流通量使得水合物的形成速度、成藏资源量甚至含水合物沉积层的成藏形态和产状上都有很大不同。Roberts et al[19]描述了墨西哥湾海底慢速、中速、快速3种渗漏区域海底的地质形态，陈多福[20]；建立了1种渗流模型并提出了1种划分这3类不同渗漏类型的标准；据此，在相同游离气饱和度情况下（进入HSZ底部的Sg均为0.1）分别计算了6种不同渗流通量，以探讨渗流通量对渗漏系统MH形成过程和成藏的影响关系。表2为在慢速、中速、快速3种渗漏通量区间内，分别计算2个不同qm值，最小从0.05 kg/m2，减少了约5.7％，判断这也是因为水合物生成速度变快后沉积层孔隙度和渗透率急剧降低，阻碍了水合物进一步的充分形成。3 神狐海域水合物成藏反演按照海底深度1 250 m、海底温度3.4℃、地温梯度为45℃/km、沉积层压力梯度10 MPa/km、孔隙平均盐度为3.5％等5个基本参数进行计算神狐海域的温压环境。目前并没有该区域HSZ内或BSR区的游离气饱和度估计，但由于整个南海北路陆坡区地质构造与墨西哥湾类似，可大致按底部进入HSZ内的游离气饱和度5％计算[20]；同时，也并不知道神狐地区深处进入HSZ底部的甲烷渗漏通量，然而，在SH2钻位约80 m厚度范围内水合物最大饱和度达48％，相比较典型的渗漏地点， Cascadia水合物脊1249、1250站位，约130 m厚度内最大饱和度可达约70％，其渗漏甲烷约为0.98 kg/(m2·a），推测神狐海域的甲烷通量可能属于中等渗漏范围内（表2）。据此，有了这些基本物性参数，结合已探测的水合物饱和度、孔隙盐度等资料，即可进行合理推测。在上述给定物性参数下，首先模拟计算了出现探测的水合物饱和度分布时的大致情况，以qm为0.5 kg/(m2·a）计算的甲烷饱和度分布图形和孔隙盐度见图3，与钻探结果相比能较好吻合，图3 神狐SH2站位水合物饱和度分布黑色点为实地测试水合物饱和度分布，红色点线为根据水合物在深度上的分布模拟获得的曲线，最大饱和度约为48％。在模型里限制海底表面处水合物饱和度为0，计算继续演化直至达最大饱和度（75%）的反应时间约5 500 ka（图4），这说明该区域在气液流进入水合物稳定区域内刚开始一段时间内大量形成并聚集。按该区域约16 km2范围内存在着甲烷水合物藏，以面积概率为10％，深度概率为20％，同时孔隙甲烷转化率假定为10％，计算得约5 500 ka后，该区域资源量达最大可达约1 250亿m3甲烷气，是当前估计的约7～8倍。图4 神狐地区SH2充分发育后的水合物分布云图4 (二)需要社会公众广泛知晓或者参与的; (三)反映本行政机关机构设置、职能、办事程序等情况的; (四)其他依照法律、 法规 和国家有关规定应当主动公开的。 第十条 县级以上各级人民政府及其部门应当依照本条例第九条的规定，在各自职责范围内确定主动公开的政府信息的具体内容，并重点公开下列政府信息： (一)行政法规、规章和规范性文件; (二)国民经济和社会发展规划、专项规划、区域规划及相关政策; (三)国民经济和社会发展统计信息; (四)财政预算、决算报告; (五)行政事业性收费的项目、依据、标准; (六)政府集中采购项目的目录、标准及实施情况; (七)行政许可的事项、依据、条件、数量、程序、期限以及申请行政许可需要提交的全部材料目录及办理情况; (八)重大建设项目的批准和实施情况; (九)扶贫、教育、医疗、社会保障、促进就业等方面的政策、措施及其实施情况; (十)突发公共事件的应急预案、预警信息及应对情况; (十一)环境保护、公共卫生、安全生产、食品药品、产品质量的监督检查情况。 第十一条 设区的市级人民政府、县级人民政府及其部门重点公开的政府信息还应当包括下列内容： (一)城乡建设和管理的重大事项; (二)社会公益事业建设情况; (三)征收或者征用土地、房屋 拆迁 及其补偿、补助费用的发放、使用情况; (四)抢险救灾、优抚、救济、社会捐助等款物的管理、使用和分配情况。 第十二条 乡(镇)人民政府应当依照本条例第九条的规定，在其职责范围内确定主动公开的政府信息的具体内容，并重点公开下列政府信息： (一)贯彻落实国家关于农村工作政策的情况; (二)财政收支、各类专项资金的管理和使用情况; (三)乡(镇)土地利用总体规划、 宅基地 使用的审核情况; (四)征收或者征用土地、房屋拆迁及其补偿、补助费用的发放、使用情况; (五)乡(镇)的 债权债务 、筹资筹劳情况; (六)抢险救灾、优抚、救济、社会捐助等款物的发放情况; (七)乡镇集体企业及其他乡镇经济实体承包、租赁、拍卖等情况; (八)执行计划生育政策的情况。 第十三条 除本条例第九条、第十条、第十一条、第十二条规定的行政机关主动公开的政府信息外，公民、法人或者其他组织还可以根据自身生产、生活、科研等特殊需要，向国务院部门、地方各级人民政府及县级以上地方人民政府部门申请获取相关政府信息。 第十四条 行政机关应当建立健全政府信息发布保密审查机制，明确审查的程序和责任。 行政机关在公开政府信息前，应当依照《中华人民共和国保守国家秘密法》以及其他法律、法规和国家有关规定对拟公开的政府信息进行审查。 行政机关对政府信息不能确定是否可以公开时，应当依照法律、法规和国家有关规定报有关主管部门或者同级保密工作部门确定。 行政机关不得公开涉及国家秘密、商业秘密、个人隐私的政府信息。但是，经权利人同意公开或者行政机关认为不公开可能对公共利益造成重大影响的涉及商业秘密、个人隐私的政府信息，可以予以公开。 第三章 方式和程序 [1] 第十五条 行政机关应当将主动公开的政府信息，通过政府公报、政府网站、新闻发布会以及报刊、广播、电视等便于公众知晓的方式公开。 第十六条 各级人民政府应当在国家档案馆、公共图书馆设置政府信息查阅场所，并配备相应的设施、设备，为公民、法人或者其他组织获取政府信息提供便利。 行政机关可以根据需要设立公共查阅室、资料索取点、信息公告栏、电子信息屏等场所、设施，公开政府信息。 行政机关应当及时向国家档案馆、公共图书馆提供主动公开的政府信息。 第十七条 行政机关制作的政府信息，由制作该政府信息的行政机关负责公开;行政机关从公民、法人或者其他组织获取的政府信息，由保存该政府信息的行政机关负责公开。法律、法规对政府信息公开的权限另有规定的，从其规定。 第十八条 属于主动公开范围的政府信息，应当自该政府信息形成或者变更之日起20个工作日内予以公开。法律、法规对政府信息公开的期限另有规定的，从其规定。 第十九条 行政机关应当编制、公布政府信息公开指南和政府信息公开目录，并及时更新。 政府信息公开指南，应当包括政府信息的分类、编排体系、获取方式，政府信息公开工作机构的名称、办公地址、办公时间、联系电话、传真号码、电子邮箱等内容。 政府信息公开目录，应当包括政府信息的索引、名称、内容概述、生成日期等内容。 第二十条 公民、法人或者其他组织依照本条例第十三条规定向行政机关申请获取政府信息的，应当采用书面形式(包括数据电文形式);采用书面形式确有困难的，申请人可以口头提出，由受理该申请的行政机关代为填写政府信息公开申请。 政府信息公开申请应当包括下列内容： (一)申请人的姓名或者名称、联系方式; (二)申请公开的政府信息的内容描述; (三)申请公开的政府信息的形式要求。 第二十一条 对申请公开的政府信息，行政机关根据下列情况分别作出答复： (一)属于公开范围的，应当告知申请人获取该政府信息的方式和途径; (二)属于不予公开范围的，应当告知申请人并说明理由; (三)依法不属于本行政机关公开或者该政府信息不存在的，应当告知申请人，对能够确定该政府信息的公开机关的，应当告知申请人该行政机关的名称、联系方式; (四)申请内容不明确的，应当告知申请人作出更改、补充。 第二十二条 申请公开的政府信息中含有不应当公开的内容，但是能够作区分处理的，行政机关应当向申请人提供可以公开的信息内容。 第二十三条 行政机关认为申请公开的政府信息涉及商业秘密、个人隐私，公开后可能损害第三方合法权益的，应当书面征求第三方的意见;第三方不同意公开的，不得公开。但是，行政机关认为不公开可能对公共利益造成重大影响的，应当予以公开，并将决定公开的政府信息内容和理由书面通知第三方。 第二十四条 行政机关收到政府信息公开申请，能够当场答复的，应当当场予以答复。 行政机关不能当场答复的，应当自收到申请之日起15个工作日内予以答复;如需延长答复期限的，应当经政府信息公开工作机构负责人同意，并告知申请人，延长答复的期限最长不得超过15个工作日。 申请公开的政府信息涉及第三方权益的，行政机关征求第三方意见所需时间不计算在本条第二款规定的期限内。 第二十五条 公民、法人或者其他组织向行政机关申请提供与其自身相关的税费缴纳、社会保障、医疗卫生等政府信息的，应当出示有效 身份证 件或者证明文件。 公民、法人或者其他组织有 证据 证明行政机关提供的与其自身相关的政府信息记录不准确的，有权要求该行政机关予以更正。该行政机关无权更正的，应当转送有权更正的行政机关处理，并告知申请人。 第二十六条 行政机关依申请公开政府信息，应当按照申请人要求的形式予以提供;无法按照申请人要求的形式提供的，可以通过安排申请人查阅相关资料、提供复制件或者其他适当形式提供。 第二十七条 行政机关依申请提供政府信息，除可以收取检索、复制、邮寄等成本费用外，不得收取其他费用。行政机关不得通过其他组织、个人以有偿服务方式提供政府信息。 行政机关收取检索、复制、邮寄等成本费用的标准由国务院价格主管部门会同国务院财政部门制定。 第二十八条 申请公开政府信息的公民确有经济困难的，经本人申请、政府信息公开工作机构负责人审核同意，可以减免相关费用。 申请公开政府信息的公民存在阅读困难或者视听障碍的，行政机关应当为其提供必要的帮助。 第四章 监督和保障 [1] 第二十九条 各级人民政府应当建立健全政府信息公开工作考核制度、社会评议制度和责任追究制度，定期对政府信息公开工作进行考核、评议。 第三十条 政府信息公开工作主管部门和监察机关负责对行政机关政府信息公开的实施情况进行监督检查。 [2] 第三十一条 各级行政机关应当在每年3月31日前公布本行政机关的政府信息公开工作年度报告。 第三十二条 政府信息公开工作年度报告应当包括下列内容： (一)行政机关主动公开政府信息的情况; (二)行政机关依申请公开政府信息和不予公开政府信息的情况; (三)政府信息公开的收费及减免情况; (四)因政府信息公开申请行政复议、提起行政 诉讼 的情况; (五)政府信息公开工作存在的主要问题及改进情况; (六)其他需要报告的事项。 第三十三条 公民、法人或者其他组织认为行政机关不依法履行政府信息公开义务的，可以向上级行政机关、监察机关或者政府信息公开工作主管部门举报。收到举报的机关应当予以调查处理。 公民、法人或者其他组织认为行政机关在政府信息公开工作中的具体行政行为侵犯其合法权益的，可以依法申请行政复议或者提起行政诉讼。 第三十四条 行政机关违反本条例的规定，未建立健全政府信息发布保密审查机制的，由监察机关、上一级行政机关责令改正;情节严重的，对行政机关主要负责人依法给予处分。 第三十五条 行政机关违反本条例的规定，有下列情形之一的，由监察机关、上一级行政机关责令改正;情节严重的，对行政机关直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的，依法追究刑事责任： (一)不依法履行政府信息公开义务的; (二)不及时更新公开的政府信息内容、政府信息公开指南和政府信息公开目录的; (三)违反规定收取费用的; (四)通过其他组织、个人以有偿服务方式提供政府信息的; (五)公开不应当公开的政府信息的; (六)违反本条例规定的其他行为。 第五章 附 则 第三十六条 法律、法规授权的具有管理公共事务职能的组织公开政府信息的活动，适用本条例。 第三十七条 教育、医疗卫生、计划生育、供水、供电、供气、供热、环保、公共交通等与人民群众利益密切相关的公共企事业单位在提供社会公共服务过程中制作、获取的信息的公开，参照本条例执行，具体办法由国务院有关主管部门或者机构制定。 综合上面所说的，信息公开对于我们公民来说是最想看到的事情，公开的信息可以让我们更快的知道国家的动态，还有对于公民的所有福利，但对于信息公开也是制定了条例的，在公开的时候不能存在有任何虚假的信息，而且必须要保护好他人的隐私，这样才算是合法的。2023-07-23 21:29:571

(二)需要社会公众广泛知晓或者参与的; (三)反映本行政机关机构设置、职能、办事程序等情况的; (四)其他依照法律、法规和国家有关规定应当主动公开的。 第十条 行政机关应当依据《条例》第十条、第十一条、第十二条和本办法的有关规定，在本机关职责范围内确定主动公开的政府信息的具体内容。 行政机关可以在保护有关当事人合法权益的前提下，根据行政管理的需要，采取适当的方式主动公开 行政处罚 、行政强制等行政执法结果信息。 第十一条 行政机关应当将主动公开的政府信息，通过政府门户网站、政府公报(包括电子版，下同)、新闻发布会以及报刊、广播、电视等便于公众知晓的方式公开。 鼓励行政机关积极拓宽政府信息主动公开渠道，利用手机短信、语音咨询等方式向社会公开政府信息。 乡(镇)人民政府根据需要，可以通过在办公场所、社区服务场所设立信息公开窗口、信息公告栏或者通过村务公开栏、广播、召开会议等方式向社会公开政府信息。 第十二条 县级以上人民政府应当将政府门户网站和政府公报作为本级人民政府的政府信息发布统一平台。 行政机关主动公开的政府信息应当在本级政府门户网站或者本机关网站公开。行政机关应当及时更新网上信息，并提供信息检索、下载等服务功能。 政府公报应当免费发放至国家机关、国家档案馆、公共图书馆、行政服务中心、社区服务场所和居(村)民委员会等。 第十三条 行政机关应当严格执行国家和省规定的新闻发布制度，指定新闻发言人，及时通过新闻发布会或者报刊、广播、电视、互联网等方式，发布重大自然灾害、事故灾难、公共卫生事件、社会安全事件以及其他需要社会公众迅速知晓的重要政府信息。 第十四条 各级人民政府应当在国家档案馆、公共图书馆设置政府信息公共查阅场所，并配备相应的设施、设备，为公民、法人或者其他组织获取政府信息提供便利。 行政机关可以在办公场所、行政服务中心、社区服务场所设立公共查阅室、资料索取点、信息公告栏、电子信息屏等，公开政府信息。 国家档案馆、公共图书馆等政府信息公共查阅场所和其他政府信息查阅场所，应当建立健全政府信息查阅服务工作制度，规范工作人员的服务行为，提高政府信息查阅服务质量。 第十五条 属于主动公开范围的政府信息，行政机关应当自该政府信息形成或者变更之日起20个工作日内予以公开。法律、法规对政府信息公开的期限另有规定的，从其规定。 第十六条 行政机关发布食品安全、农产品质量安全状况、重大传染病疫情、重大动植物疫情、重要地理信息数据、统计信息、地震预报等政府信息，应当严格按照法律、法规和国家规定的权限、程序执行。 第三章 依申请公开 第十七条 公民、法人和其他组织有权根据《条例》和本办法的规定，向行政机关申请获取相关政府信息。 行政机关应当加强政府信息依申请公开工作，畅通申请渠道，认真答复相关申请，提高工作效率和服务质量。 第十八条 公民、法人和其他组织申请获取政府信息，可以到行政机关办公场所或者行政机关指定的国家档案馆、行政服务中心等政府信息公开申请受理点，当场提出书面申请;也可以通过信函、传真、互联网等方式和途径提出书面申请。 采用书面形式确有困难的，申请人可以当场口头提出申请，由受理该申请的行政机关代为填写申请书，并由申请人核实后签字或者盖章确认。 行政机关应当提供和公布政府信息公开 申请书格式 文本，方便申请人免费获取。 第十九条 申请人应当如实填写姓名或者名称、联系方式;申请公开的政府信息的内容描述和形式要求应当明确、具体。 申请人委托他人申请公开与其自身相关的政府信息的，应当向行政机关提交申请人、被委托人的有效证件以及 授权委托书 。授权委托书应当载明委托事项、权限和期限，并由申请人签名或者盖章。 第二十条 对申请公开的政府信息，行政机关应当按照下列规定分别作出书面答复处理: (一)属于公开范围的，应当告知申请人获取该政府信息的方式和途径;能够在答复时提供具体内容的，应当同时提供。 (二)属于不予公开范围的，应当告知申请人并说明理由。 (三)属于行政机关之间和行政机关内部行文的请示、报告、批复、会议纪要、抄告单等文件和资料，不作为行政管理依据的，可以不予公开，但应当告知申请人并说明理由;作为行政管理依据的，应当予以公开，并按照本条第(一)项规定答复处理。 (四)属于正在调查、讨论、处理过程中的政府信息，可以不予公开，但应当告知申请人并说明理由。 (五)不属于主动公开的范围，且与申请人生产、生活、科研等特殊需要无关的，可以不予公开，但应当告知申请人并说明理由。 (六)不属于本机关负责公开或者该政府信息不存在的，应当告知申请人;对能够确定负责公开该政府信息的行政机关的，应当告知申请人该行政机关的名称、联系方式。 (七)含有不应当公开的内容，但能够作区分处理的，应当告知申请人可以部分公开及公开部分的获取方式和途径;对不予公开的部分，应当说明理由。 (八)申请内容不明确或者申请不符合规定要求的，应当一次性告知申请人需要补正的内容。 (九)同一申请人向同一行政机关就同一内容反复提出政府信息公开申请，行政机关已经答复的，可以告知申请人不再重复处理。 第二十一条 申请公开的政府信息由两个以上的行政机关共同制作的，由受理申请的行政机关提供。 申请政府信息公开，要求行政机关提供报刊、书籍等公开出版物，或者提供应当依照有关法律、法规规定查阅的案卷材料，或者为其制作、收集、分析、加工政府信息的服务的，行政机关应当书面告知申请人不予提供。 以申请政府信息公开的名义向行政机关提出信访事项的，行政机关应当书面告知申请人通过相应的法定途径提出。 第二十二条 行政机关收到政府信息公开申请，能够当场答复的，应当当场予以答复;不能当场答复的，应当自收到申请之日起15个工作日内予以答复。行政机关需要延长答复期限的，应当经政府信息公开工作机构负责人同意，并书面告知申请人。延长答复的期限最长不得超过15个工作日。 申请公开的政府信息涉及国家秘密、商业秘密和个人隐私，需要按照规定进行保密审查或者征求第三方意见，可能超过规定答复期限的，行政机关应当书面告知申请人。 对拟予以公开的政府信息，行政机关在答复时不能同时提供的，应当确定并告知申请人提供的期限。 第二十三条 行政机关依申请提供政府信息的，应当依照申请人要求的形式予以提供;无法依照申请人要求的形式提供的，可以通过安排申请人查阅相关资料、提供复制件、摘抄或者其他适当形式提供。法律、法规、规章另有规定的，从其规定。 申请公开政府信息的公民存在阅读困难或者视听障碍的，行政机关应当为其提供必要的帮助。 第二十四条 行政机关依申请提供政府信息，除可以收取检索、复制、邮寄等成本费用外，不得收取其他任何费用，不得要求申请人通过其他组织、个人以有偿方式获取政府信息。 申请公开政府信息的公民确有经济困难的，经本人申请、受理申请的政府信息公开工作机构负责人审核同意，可以减免相关费用。 行政机关收取检索、复制、邮寄等成本费用的标准以及相关费用减免办法由省价格、财政主管部门按照国家有关规定制定。 第二十五条 公民、法人或者其他组织有 证据 证明行政机关提供的与自身相关的政府信息记录不准确的，有权要求该行政机关予以更正。 行政机关收到政府信息记录更正要求后，应当进行核查，并按照下列规定作出处理;法律、法规、规章另有规定的，从其规定: (一)有权更正且能够当场更正的，应当当场更正有关政府信息记录;不能够当场更正的，应当自收到更正要求之日起7个工作日内予以更正;认为政府信息记录准确的，应当书面告知申请人不予更正，并说明理由。 (二)无权更正的，应当自收到更正要求之日起5个工作日内转送有权更正的行政机关处理，并书面告知申请人，说明理由。 第四章 管理与监督 第二十六条 行政机关应当依照《条例》第十九条的规定，编制、公布本机关的政府信息公开指南和目录，并及时修订完善。 政府信息公开指南和目录应当科学合理，便于查阅。 政府信息公开工作主管部门应当加强政府信息公开指南和目录编制、公布工作的指导和监督。 第二十七条 县级以上人民政府应当充分利用现有政务信息网络资源，推进本行政区域的政府信息公开信息化平台建设，整合和优化信息发布、申请处理、信息查询等功能，实现与上级人民政府、所属工作部门、下级人民政府的政府信息公开系统的互联互通，提高政府信息公开工作质量和效率。 第二十八条 行政机关公开政府信息前，应当按照国家和省有关规定进行保密审查;在拟订公文时，应当明确该公文是否公开。 政府信息不能确定是否可以公开的，应当依法报有关主管部门或者同级保密行政主管部门确定;其中不能确定是否危及社会稳定的，还应当按照国家和省有关规定进行社会稳定风险评估。 政府信息主要内容需要公众知晓或者参与，但其中部分内容涉及国家秘密的，应当经法定程序解密或者删除涉密内容。 政府信息涉及商业秘密、个人隐私，公开后可能损害权利人合法权益的，应当书面征求权利人的意见;权利人不同意公开的，不得公开;权利人未在行政机关规定的期限内答复的，视为不同意公开。行政机关认为不公开可能对公共利益造成重大影响而决定予以公开的，应当将决定公开的内容和理由书面告知权利人。 第二十九条 行政机关发布政府信息涉及其他行政机关的，应当与有关行政机关沟通、确认，达成一致意见后方可发布;不能达成一致意见的，应当报请共同的上一级行政机关协调解决。 行政机关发现影响或者可能影响社会稳定、扰乱社会管理秩序的虚假或者不完整信息的，应当在其职责范围内及时发布准确的政府信息予以澄清。 行政机关发布政府信息依照国家有关规定需要批准的，应当报经有权机关批准。 第三十条 行政机关制作或者保存的政府信息已移交国家档案馆和档案工作机构的，其公开依照有关档案管理的法律、法规和国家有关规定执行;尚未移交的，其公开依照《条例》和本办法的有关规定执行。 第三十一条 行政机关应当在每年3月31日前，通过政府门户网站、本机关网站或者新闻媒体公布本机关的政府信息公开工作年度报告。政府信息公开工作年度报告的内容依照《条例》的规定执行。 第三十二条 县级以上人民政府应当每年对所属工作部门和下一级人民政府的政府信息公开工作情况进行考核。 政府信息公开工作主管部门、监察机关应当依照职责对行政机关政府信息公开工作情况进行监督检查。 政府信息公开工作主管部门应当组织或者委托统计等有关部门和机构定期对本行政区域的政府信息公开工作情况进行社会评议，并公布社会评议情况。 第三十三条 公民、法人或者其他组织认为行政机关不依法履行政府信息公开义务的，可以向上级行政机关、监察机关或者政府信息公开工作主管部门举报和投诉;收到举报和投诉的行政机关应当按照国家和省有关规定予以调查处理。 公民、法人或者其他组织认为在政府信息公开工作中的具体行政行为侵犯其合法权益的，可以依法申请行政复议或者提起行政 诉讼 。 第三十四条 行政机关未建立健全政府信息发布保密审查机制的，由监察机关或者上一级行政机关按照管理权限责令改正;情节严重的，对行政机关主要负责人依法给予处分。 行政机关有下列情形之一的，由监察机关或者上一级行政机关按照管理权限责令改正;情节严重的，对行政机关直接负责的主管人员和其他直接责任人员依法给予处分;构成犯罪的，依法追究刑事责任: (一)不依法履行政府信息公开义务的;
