法律主观：安全生产责任制是《中华人民共和国 安全生产法 》规定的。 1.生产经营单位的安全生产管理责任主要包括制度管理责任、人员管理责任、现场管理责任、事故报告责任和法律法规规定的其他安全生产责任。 2.生产经营单位要依据法律法规、国家标准和行业标准，制定涵盖生产经营全过程和全体从业人员的安全生产管理制度。主要包括：（一）安全生产会议制度；（二）安全生产投入及安全生产费用提取和使用制度；（三）安全生产教育培训制度；（四）安全生产检查制度；（五）安全生产责任制考核、奖惩和责任追究制度；（六）操作规程及岗位标准化管理制度；（七） 安全生产事故 隐患排查治理制度；（八）重大危险源检测、监控、管理制度；（九）劳动防护用品配备和管理制度；（十）安全设施、设备管理和检修、维护制度；（十一）新建、改建、扩建项目工程“三同时”制度；（十二）特种作业人员管理制度；（十三） 生产安全事故 报告、应急救援、调查处理、档案管理制度；（十四）其他符合本行业、本单位生产特点的安全生产管理制度。 3.生产经营单位要教育督促从业人员遵守安全生产法律法规、规程标准和安全技术措施，组织从业人员参加安全生产教育培训，确保从业人员培训合格后上岗作业。杜绝违章指挥、违章操作和违反劳动纪律行为。 4.生产经营单位要加强重大危险源管理，建立重大危险源安全运行档案，依法进行重大危险源申报、评估和定期检测检验，采取切实可行的安全措施，加强对重大危险源的监控和对有关设备设施的安全管理。 5.生产经营单位要定期开展安全检查，根据安全生产的重点环节，及时排查治理事故隐患；暂时难以整改的，要制定整改计划，落实整改措施，限期整改。每次安全检查的内容、结果、整改情况要记入台帐，并由检查人员、复查人员签字。 生产经营单位的生产区、生活区、储存区之间要保持规定的安全距离。生产、经营、储存、使用危险物品的车间、商店和仓库周边的安全防护要符合国家有关规定，生产经营场所和员工宿舍应当设有标志明显、符合紧急疏散要求的安全出口。 7.生产经营单位发生生产安全事故后，事故现场有关人员要立即向本单位负责人报告。单位负责人接到报告后，要按照规定向县级以上人民政府安全生产监督管理部门和有关部门报告，不得瞒报、迟报、谎报生产安全事故。生产经营单位负责人同时必须坚守岗位，立即组织救援，配合事故调查组开展事故调查，依法妥善处理事故善后工作。 8.生产经营单位要按照安全生产法律法规要求，不断改善生产条件，提高保障水平，落实安全生产保障责任。主要包括投入保障责任、组织保障责任、技术保障责任、应急救援保障责任以及法律法规规定的其他保障责任。 9.生产经营单位要按规定提取安全生产费用，保证本单位安全投入满足安全生产条件需要。安全生产投入必须纳入本单位经费预算。安全生产投入主要用于下列事项：（一）安全生产设施设备的建设、改造和维护；（二）安全事故隐患整改、职业卫生条件改善和安全标准化建设；（三）安全生产评价评估、检测检验、咨询论证等技术服务；（四）劳动防护用品、应急救援器材药品配备；（五）安全检查所需交通工具、设备仪器、通讯器材购置；（六）安全生产科技开发与应用、宣传教育和奖励；（七） 职工伤亡事故 调查处理及善后；（八）安全生产保障所需的其他费用。 10.生产经营单位要设置安全生产管理机构或者配备专职安全生产管理人员。规模在300人以上的生产经营单位，要设立安全生产管理机构，300人以下的生产经营单位，要配备专职或者兼职安全生产管理人员，或委托和聘用具备国家注册安全资质的人员提供安全管理服务。 11.生产经营单位要按照安全标准化达标有关规定，在生产经营的各环节、各岗位开展安全标准化建设工作。对安全标准化建设持续达标的生产经营单位，应当予以表彰奖励。 12.生产经营单位新建、改建、扩建项目的安全设施，要与主体工程同时设计、同时施工、同时投入生产使用。（一）建设项目设计单位在编制项目设计文件时，要同时编制安全设施的设计文件；（二）建设项目施工单位要严格按照安全设施的施工图纸和设计要求施工；（三）在生产设备调试阶段，要同时对安全设施进行调试和考核，对其效果作出评价；（四）安全设施的设计和竣工验收须报经安全生产监督管理部门组织审查验收。 13.矿山建设项目、用于生产或者储存危险物品的建设项目、使用危险化学品作为生产原料和设备设施构成重大危险源等危险性较大的建设项目，在立项前要依法进行安全条件论证和安全预评价。 14.生产经营单位要按照规定对安全设施、设备进行维护、保养和定期检测，保证安全设施、设备正常运转。维护、保养、检测要做好记录，并由相关人员签字。 15.生产经营单位要为劳动者提供符合国家职业卫生标准的工作环境和条件，按照国家标准或者行业标准为从业人员无偿提供合格的劳动防护用品，并督促、教育从业人员按照使用规则正确佩戴和使用，不得以货币或者其他物品替代劳动防护用品。 16.生产经营单位应当依法为从业人员 办理工伤保险 ，并可根据安全生产实际为从事高空、高压、易燃、易爆、剧毒、放射性、运输、野外、矿山开采等高危作业的人员办理意外伤害保险。 17.生产经营单位要依法制定生产安全事故应急救援预案和操作岗位应急处理措施。制定的预案必须予以公布，每年至少组织一次演练。 18.危险物品的生产、经营、储存单位以及矿山、建筑施工单位要建立应急救援组织，配备相应的应急救援器材和设备，并定期进行演练。无应急救援组织的单位，要配备应急救援人员，并与就近的应急救援组织签订应急救援协议。 19.生产经营单位在改制、破产、收购、兼并、整合、重组等产权变动期间，产权的转让方和受让方要签订专门的安全生产管理协议，或者在产权变动合同中约定有关安全生产管理事项。未签订安全生产管理协议或者未约定安全生产管理事项，发生生产安全事故的，由事故发生单位的 实际控制人 承担相应后果。 20.生产经营单位必须依法建立健全本单位安全生产责任制，明确各岗位责任人员、责任内容，落实全员安全生产责任。（一）主要负责人（董事长、总经理）的安全生产责任；（二）主管安全生产工作的负责人和其他分管负责人（副董事长、副总经理）的安全生产责任；（三）部门（安全生产管理机构、各管理处室、分公司、车间）负责人的安全生产责任；（四）班组长的安全生产责任；（五）岗位从业人员的安全生产责任。 21.生产经营单位的主要负责人是本单位安全生产的第一责任人，对落实安全生产主体责任全面负责，职责如下：（一）建立健全安全生产责任制；（二）组织制定安全生产管理制度和操作规程；（三）保证安全生产投入的有效实施；（四）定期研究安全生产问题，督促其他分管负责人的安全生产工作，及时消除生产安全事故隐患；（五）组织制定并实施生产安全事故应急救援预案；（六）及时报告生产安全事故，有效组织事故救援，协助、配合事故查处；（七）法律、法规规定的其他职责。 22.生产经营单位主管安全生产的负责人，对安全生产负直接领导责任，协助主要负责人做好安全生产工作。具体职责是：（一）定期召开安全生产会议，听取安全生产管理机构和其他部门的汇报，研究解决安全生产问题；（二）落实安全生产的管理制度、操作规程和安全生产责任制，组织查处作业过程中的违章指挥、违章作业和违法劳动纪律的行为；（三）对服役使用的设施设备、工艺流程和作业场所的职业卫生状况定期组织检查和检测检验，保证设施设备完好性、工艺流程的安全性和职业卫生状况符合有关规定和标准；（四）对重大危险源进行登记建档监控，组织排除或治理安全生产隐患，协助、配合事故查处；（五）及时修订完善应急预案，定期组织演练。 23.生产经营单位其他负责人按照“一岗双责”和“谁主管，谁负责”的原则，协助主要负责人和主管安全生产负责人做好安全生产工作，并对分管范围内的安全生产承担相应领导责任。 24.生产经营单位主要负责人要认真履行安全生产监督职责，对未落实安全生产主体责任而导致的后果负责。 25.生产经营单位要依据安全生产制度划分具体责任，逐级逐岗签订安全生产责任书，并对落实安全生产责任定期组织考核。 26.生产经营单位应当将安全生产责任制考核情况列入经营管理人员业绩考察的内容。 27.生产经营单位要建立健全内部监督机制，充分发挥董事会、股东会、职代会的监督作用，自觉接受工会和职工的民主监督。法律客观：《中华人民共和国安全生产法》第十六条 国家实行生产安全事故责任追究制度，依照本法和有关法律、法规的规定，追究生产安全事故责任人员的法律责任。 《中华人民共和国安全生产法》第五条 生产经营单位的主要负责人是本单位安全生产第一责任人，对本单位的安全生产工作全面负责。其他负责人对职责范围内的安全生产工作负责。
