英语的从句

这个应该是表语从句。BE动词后面跟的都是表语。实义动词后面的才是宾语。

从句有两大类:

限定性从句

非限定性从句

谓语动词是与非谓语动词相对应的概念.两者都是动词,但是前者是作谓语成分,后者不能作谓语成分.而谓语成分就是用来说明主语的动作或状态的,一般由动词或短语动词承担.

比如:我看电视.”看”就是谓语.

你正在上网.”上网”也是谓语.

再举几个英语句子吧:I see a girl.我看见一个女孩.”看见””see"就是这个句子的谓语.而see也是个动词,所以就叫做谓语动词.She is very beautiful.她很漂亮."is"就是这个句子的谓语,也是动词.

从句是指用于复合句中担当某个句子成分的主谓结构。虽说从句自身的句子结构是完整的, 但是它不能视为独立的句子,因为它离开了主语就无法独立、完整地表达意思。按其所能表达的意义而言,它相当于一个词或是一个词组.例如: 1) Because they talk at home while the television is on , many people think they can talk at movies as well . (状语从句)许多人在家里是边看电视边谈话,所以他们认为在电影院也可以如此。 2) Whether he comes or not doesn"t make any difference to me . (主语从句) 他来与不来对我都一样。 3)There is disagreement among economists about what money is and how money is measured(宾语从句)什么是货币以及怎样计量货币经济学家之间存有分歧。 4) China is not what it used to be . (表语从句)中国不是它过去的样子了。 5) Is there any proof that the food of plant differs from that of animals ? (同位语从句)有没有什么证据说明植物性食品不同于动物性食品? 6) Taxes consist of money that people pay to support their government . (定语从句) 税款是人们支持政府而交的钱。 如果将上面的复合句中所有的从句都独立出来,那将是这样的: 1) Because they talk at home while the television is on 2) Whether he comes or not 3) what money is and how money is measured 4) what it used to be 5) that the food of plant differs from that of animals 6) that people pay to support their government 我们很容易看出,上面的所有这些句子既不是陈述句、疑问句,也不是祁使句,更不是感叹句。也就是说,它们不是独立的句子;也只有在附属于主句后才能获得意义如下:1)因为许多人在家里是边看电视边谈话 2)他来与不来 3)什么是货币以及怎样计量货币 4)它过去的样子5)植物性食品不同于动物性食品6)人们支持政府而交的上面的这些句子在我们中文里如同是人们常说的"半截话";在英文中也就是个"词或词组"了。 B. 我们虽然说过,从句自身的句子结构基本是完整的,但是它不同于"独立句子"的是--每个从句的最前面都好象"戴了顶帽子"即:从属关系词。由此可以看出,从句的另一个特点是:从属关系词总是立于从句之首. C. 从句的再一个特点是:一般说来(除少数倒装的情况外),从句中的语序应该是正常语序。 D. 关于从句种类的划分有两种方法:按从句的词性划分和按从句的句子功能划分。如果按从句的词性划分,从句可分为三种:名词从句、形容词从句和副词从句。如果按从句的句子功能划分(也就是按从句在句子中所担任的成分来划分),从句可分为:主语从句、宾语从句、 表语从句、同位语从句、定语从句和状语从句。其实,这两种划分从句的方法在逻辑上是一致的.我们知道,能在句子里充当主语、宾语、表语和同位语的往往是名词、代词等,所以名词从句涵盖了主语从句、宾语从句、表语从句和同位语从句。形容词和副词常分别在句中担当定语和状语,所以,形容词从句和副词从句其实分别是定语从句和状语从句。 名词从句名词从句在句中是一个相当于名词的主谓结构。我们在前面说过,名词从句含盖了主语从句、宾语从句、表语从句和同位语从句。连接这些从句与主句的关系词主要有三类: 1.从属连词:that(无有词义) , whether(是否) ,if (是否) 2.关系代词:who(谁,主格) , whom(谁,宾格),whose谁的,所有格) , what(什么),which(哪个,哪些) 3.关系副词:when(什么时候) where(什么地方)why(为什么) , how(怎样) 名词从句中的从属连词在从句里不担任任何成分,只起连接的作用;而关系代词和关系副词不仅仅是起连接的作用,而且还在从句里担任一定的成分;关系代词常在从句中担任主语、宾语或表语等成分;关系副词常在从句中担任状语。另外,在使用上面的这些关系词时,有几个问题值得我们注意:首先,只能用whether而不能用if的情况. 1)引导主语从句,例如: Whether we"ll make a loan for the project has not been decided .(正确)我们是否要为这个项目还没有定下来。 OR: It has not been decided whether we"ll make a loan for the project . (正确) If we"ll make a loan for the project has not been decided .(错误) OR: It has not been decided if we"ll make a loan for the project . (错误) 2)作介词的宾语,例如: I have no idea about whether I can raise the money for buying a car . (正确)我不知道我是否能为买车筹措到资金。 I have no idea about if I can raise the money for buying a car . (错误) 3)后接不定式 ,例如: He didn"t know whether to go all himself first or wait for her here.(正确)他不知道是他自己先去还是在这儿等她。 He didn"t know if to go all himself or wait for her here . (错误) 4)后接or not ,例如: We wonder whether they"ll come in time or not.(正确) 我们担心他们会不会准时到。 We wonder if they"ll come in time or not . (错误)其次,what引导的名词从句表达的意思是"……所……的"。这个"所怎么的"定义根据"从句谓语的动作意义"而定。例如: I don"t understand what you said.我不理解你所说的话。 What he needs is to practice more.他所需要的是勤于练习。 Money is what she is really after.金钱是她所真正追求的东西。 People have different ideas about what happiness means . 人们对于幸福的含义有不同见解。最后,要了解 -ever = no matter ,用于表示强调,意为"无论……"。也就是说: whatever = no matter what(无论什么) whoever = no matter who(无论谁) whichever = no matter which(无论那个) whenever =no matter when (无论何时) wherever = no matter where(无论何地) however = no matter how (无论怎样) A 主语从句用作主语的主谓结构称之为主语从句。例如: Whether he"ll come or not remains a question . 他是否会来依然是一个问题。 Whoever says that is not allowed .无论谁这样说都是不允许的。 That she reads English aloud every morning helps her a lot in the improvement of her English study . 她每天早晨朗读英文对提高她的英语学习起了很大的作用。 要点提示在使用主语从句中,有几个问题值得我们注意: 1)尽管主从连词that在主语从句中没有任何意义,但一般不能省略。 That there is no elevator in the building is the critical inconvenience .这幢楼里没有电梯是极大的不便之处。 It is necessary (that) he have his further study incollege.(当主语从句在后面时,连词that可以省去)他在大学进一步深造是完全必要的。 2)为了保持句子平衡或在正式文体中,常用先行It代替主语从句而将主语从句置于句末。 It remains a question Whether he"ll come or not . 他是否会来,依然是一个问题。 It is not allowed Whoever says that. 无论谁这样说都是不允许的。 3)在It + be +形容词/ 名词 + that从句的结构中,由于某些形容词/ 名词的原因,that从句中的谓语动词要用虚拟式。这类形容词/ 名词常见的有: essential(绝对必要的), important(重要的), advisable(明智的), desirable(希望能够的), imperative(必须的), natural(自然的), necessary必要的), regretful(遗憾的), strange(奇怪的), proper(适当的), urgent(紧急的), duty(义务、责任), a pity (遗憾), no wonder(难怪), a regret(遗憾)。例如: It is strange that he ( should ) say so . 他居然会这样说,真是奇怪。 It is a great pity that you ( should ) think so . 他居然会这样想,真是一件憾事。 It is natural that a bird ( should ) rest in trees . 鸟在树上安歇是很自然的。 It is a wonder that he should have passed the exam. 他这次考试居然会及格,真是个奇迹。 4)以what引导的主语从句常用于句首表示强调。 What they need now is financial aid . 他们现在所需要的是经济援助。 What she thinks of me doesn"t mean much to me . 她怎么样看我,对我来说无所谓。 What you have said hurt her a lot .你所说的话对她伤害很大。 B 宾语从句用作谓语动词、介词以及非谓语动词形式的宾语的主谓结构称之为宾语从句。也就是说,只要是用一个主谓结构去充当宾语,那么这个主谓结构就称为宾语从句。 例如: I believe that he will find a job in that publisher .(作谓语动词的宾语)我相信,他一定会在那家出版社找到工作。 He laughed at what they said . (作介词的宾语)她对他们说的话,一笑置之。 要点提示在使用宾语从句中,有几个问题值得我们注意: 1)宾语从句与主句的时态一致性问题这种一致性的要求,只有当主句的谓语动词用于"过去时区"的时候才存在。凡是在"过去时区"内的各种不同时态都在其中。另外,这种一致性只要求宾语从句的谓语动词也用于"过去时区"即可,至于用什么样具体的时态就要依从句的需要而定了。 He had told me that he would join the club sometime . 他曾经告诉我说,他会在某个时候参加俱乐部的。 I remembered that I had met him somewhere . 我记得我曾在哪儿见过他。 She thought that she would have finished what she was doing by the end of the month . 她认为在那个月底她将完成她手头上做的事。 2)if引导的宾语从句不能作介词的宾语,而只有用whether引导才行。这一点在上面刚刚讲过.(略) 3)某些动词后面,宾语从句的谓语要求用虚拟式。这一点已在"虚拟语气"一章中讨论过了,本章只作简单的复习。这类要求宾语从句的谓语用虚拟式的动词,常见的有:command(命令), demand(要求), desire(希望), insist(坚持), order(命令), propose(提议), recommend(推荐), request(要求), require(要求), suggest(建议),等。例如: He proposed that we ( should ) set a dead line for the complement of the plan . 他提议拟定一个执行计划的期限。 C 表语从句在句子中担当表语的主谓结构称之为表语从句。它常位于句中联系动词或是起联系动词作用的动词之后.例如: The problem is where we can hold our meeting . 问题是我们可以在哪儿举行会议。 It seems that everything goes smoothly .似乎一切都进行得很顺利。 The cause is that the temperature of water is lower that needed . 其原因是水的温度低于所需要的温度。 That is what he really wants .那就是他真想要的东西。 D 同位语从句同位语从句就是在句子中担当同位语的主谓结构.在使用同位语从句时要特别注意:尽管主从连词that在同位语从句中没有任何意义,但却不能省略。另外,同位语从句常用于下面这些名词的后面(其中,斜体字的名词后面所接的同位语从句中要用虚拟语气): fact(事实), fear(担心、害怕), belief(信念,意见), evidence(证据), hope(希望), idea(想法) news(新闻), doubt(怀疑), suggestion(建议), motion(动议), proposal(提议), order(命令), recommendation(推荐),等等。例如: There is the news that an American delegation will arrive in Beijing tomorrow afternoon . 有消息说一个美国代表团将于明天下午抵达北京。 Is there any proof that the food of the plant differs from that of animals ? 是否有任何证据可以说明植物性的食物不同于动物性的食物呢? We all know the fact that organization helps memorization. 我们都知道这样一个事实:把要记忆的材料组织起来有助于记忆。 What do you think of his proposal that we ( should ) put on a play at the English evening ? 他建议我们在英语晚会上演一个剧,你觉得怎么样?

延续性动词

延续性动词表示行为或过程能持久地继续下去或能产生持久的影响。这类动词有:contain,have,hold, lie,live,make,sit,rain,sleep,stand,study,wait, wear,work等。此外,表示状态、感情、思维等动词,如:believe,consider,hate,hope,know,like,love,respect,think,understand,wish等也属延续性动词。要表示状态和延续性动作时必须要用延续性动词。如:

错:This book has been put on the desk for a week.

对:This book has been lying on the desk for a week.

这本书已经在桌子上放一个星期了。

错:Men put on suits when they attend meetings.

对:Men wear suits when they attend meetings.

I remember when this used to be a quiet village.我记得这里曾经是一个僻静的村庄。   (4)由从属连词whether或if引导的宾语从句。   I wonder whether (if) daughters are valued as much as sons in the countryside.我想知道在农村女儿是否和儿子一样受到重视。   I don"t know whether (if) you are willing to help me.我不知道你是否愿意帮我。注意:whether 和if的区别,请参考概述部分。   (5)动词+间接宾语+宾语从句。动词如:advise, ask, inform, promise, question, remind, show, teach, tell, warn等,宾语从句前可以有一个间接宾语,这个宾语有时可以省略,有的不能省略。   He has informed me when they are to discuss my proposal.他已经通知我们将什么时候讨论我的建议。(me不可省略)   She promised (us) that she would give us more help later on.她答应以后给我们更多的帮助。(us可省略)   3、作介词宾语   It depends on whether he is coming or not.这要看他是否会来。   I was curious as to what we could do next.我想知道下一步我们该做什么。注意:that引导的宾语从句只在in, but, except, besides等少数介词后作宾语,形成固定搭配,in that在于(因为),but that要不是(只是),except that除了……。   The higher income tax is harmful in that it may discourage people from trying to earn more.所得税过高是有害的,因为它可能使人不愿多赚钱。   His paper is perfect except that there were some misprints.除了一些印刷错误之外,这篇论文很好。   4、作形容词宾语。   No one can be sure what man will look like in a million years.谁也不知道一百万年后人类会变成什么样子。   I am not certain whether I have met him before.我不能肯定从前是否见过他。   I"m sorry (that) you"re ill.你病了,我很难过。注意:that引导的从句在下列形容词后面作宾语,that可以省略。anxious, aware, certain, confident, convinced, determined, glad, proud, surprised, worried, sorry, thankful, ashamed, disappointed, annoyed, pleased, hurt, satisfied, content, proud等。   I"m sure (that) he"ll help you.我确信他会帮助你。   I"m glad (that)he has passed the exam.我很高兴,他考试及格了。   5、it充当形式宾语,真正的`宾语---宾语从句后置。正如我们常用it充当形式主语代替主语从句一样,我们也常用it用作形式宾语代替宾语从句,把真正的宾语从句后置。特别是带复合宾语的句子中。在这种结构中that不可省略。有下列几种情况:   (1)在believe, consider, declare, estimate, fancy, feel, find, guess,hear, imagine, know, make, prove, reckon, think, understand 等动词接复合宾语(宾语+宾补)时,要用it作形式宾语。   We find it difficult that we should finish the work on time.我发现我们按时完成工作有困难。   She thinks it wrong that he didn"t answer the phone.她认为他不接电话是不对的。   (2)在like,enjoy,love,hate,take 等表“喜怒哀乐”的动词,后若要跟宾语从句时,需跟形式宾语 it。   I hate it when people talk with their mouths full.我不喜欢人们满口饭说话。   I like it that everyone passed the exam.都通过了考试我很喜欢。   (3)由动词和介词构成的短语动词后接 that 宾语从句时,要用形式宾语。   We are thinking of it that we"ll lend you some money.我正在考虑借给你钱的事。   I shall see to it that he is taken good care of when you are absent.你不在的时候我负责把他照顾好。   (4)用于“动词+宾语+介词短语”的句型中。   Keep it in mind that you have to be home by ten o"clock.要记住你得十点钟之前回家。   We took it for granted that he would come.我们认为他来是当然的。   6、不可直接跟that从句的动词。下列动词不可直接接that从句:ask, refuse, let, like, cause, force, condemn, admire, entreat, dislike(厌恶), overlook, love, help, take, forgive, bid, hate, hear(听见), see(看见), want(想要) 等,但可用it, the fact做媒介,后接that从句;或接动名词、不定式。   He overlooked it that he had made another mistake.(正确) 他忽视了一件事,他又犯了一个错误。   He overlooked the fact that he had made another mistake. (正确)   He overlooked that he had made another mistake.(错误)   I admire it that they won the match. (正确)   I admire the fact that they won the match. (正确) 我很羡慕,他们赢得了比赛。   I admire that they won the match. (错误)   7、that引导宾语从句的省略。   (1)主句谓语动词是agree, argue, hold, learn, maintain, observe, contend, conceive, reckon, remark, state, suggest, assume, announce, calculate, indicate等时,其后宾语从句的引导词that一般不可省略;主句谓语动词是hear, know, say, see, confess consider, declare, understand, propose等时,其后宾语从句的引导词that可以省略,也可以不省略;主句谓语动词是think, suppose, believe, presume, dare say等时,其后宾语从句的引导词that可以省略。   He suggested that we should set off at 8 o"clock tomorrow morning.他建议我们明天早晨8点走。(that不可省略)   I think (that) this is very important.我认为这很重要。(that可省略)   (2)当一个句子很复杂,句中有多个状语时,that不可省略;或者一个句子有多个并列的宾语从句时,特别第一个宾语从句特别长,后面的宾语从句的that不可省略;谓语动词与that从句之间有插入语时,that不可省去。   He said you needn"t worry and that he would help you .他说你没有必要着急,他会帮助你的。(said之后可省去that,但第二个that不可省去)   We decide, as he has suggested, that we will start out tomorrow.就像他建议的那样,我们决定明天动身。   8、否定转移与省略   (1)如果主句的谓语动词是“think, consider, suppose, believe, expect, fancy, guess, reckon, imagine等,主语是第一人称的一般现在时态,其后的宾语从句如含有否定意义,一定要把否定词一道主句谓语上,从句谓语动词用肯定形式。   I don"t think he can do it better than me.我想他不会比我干得好。   I don"t believe he treated the child like that.我相信他不会那样对待孩子的。   (2)如果think, consider, suppose, believe, expect, fancy, guess, reckon, imagine等前有副词或表示强调的do, does, did;或者同其它词构成并列谓语;或者不以现在时出现;或者用作插入语中。这时候不用否定转移。   I really expect she didn"t say that to him.我确实希望她不和他说那件事。   I think and hope that he won"t be deceived by the man.我认为也希望他不会被那个人欺骗。   (3)think, consider, suppose, believe, expect, fancy, guess, reckon, imagine等此类动词后,在简略答语中,用 so 替代前文肯定的宾语从句;若替代一个否定的宾语从句,用 not 或 not…so 替代前文整个从句。   -I believe we"ve met somewhere before.我认为我们从前在哪见过。   -No,I don"t think so.没有,我认为我们以前没见过。   -Do you think it"s going to rain over the weekend?你认为这周末会下雨吗?   -I believe not.我认为不会。注意:hope 只能说 I hope not 一种形式,因为 hope 不能否定转移。   9、时态的呼应与语序。   在宾语从句中只能用陈述句语序,时态呼应上要遵循以下三条原则:   (1)如果主句谓语是一般现在时或将来时,宾语从句的谓语可根据意思的需要使用任何一种时态。   Can you make sure where Alice has put the gold ring?你能确定爱丽丝把金戒指放到什么地方了吗?   They have no idea at all where he has gone.他们一点也不知道他去了哪。   Do you know who he was talking with at eight last night?你知道他昨晚和谁一起说话吗?   (2)如果主句谓语是一般过去时,宾语从句要用表示过去的某一时态。   He said he would come to see us the next day.他说他明天将来看我们。   I wanted to know whether he had been to Beijing.我想知道他是否去过北京。   (3)如果宾语从句是表示客观事实、真理等,不管主句是什么时态,宾语从句一律用一般现在时。   Dick asked Lucy how old she is.迪克问露斯她多大了。   The teacher said the sun rises in the east.老师说太阳从东方升起。   要点   一、高中宾语从句要点之时态的呼应   1. 如果主句是一般现在时、一般将来时或祈使句时,宾语从句可根据情况使用各种时态。例如:   I hear she is here today(she was here yesterday/ she will be here tomorrow.)   2. 如果主句是一般过去时,宾语从句应使用过去时态的某种形式。例如:   He said he was watching TV(he had swept the floor/ he would play football after school)。   3. 如宾语从句所叙述的是客观事实、自然现象或科学真理等,从句不受主句时态限制,仍用一般现在时。例如:   Our teacher told us that light travels faster than sound.   二、高中宾语从句要点之引导词的使用   1. 当宾语从句由陈述句变化而来时,用that来引导从句,that常无具体意义,一般可省略。例如:   Lin Tao thought(that)the TV play was very boring.   2. 当宾语从句是由一般疑问句变化而来时,要用if或whether来引导从句。例如:   David asked his mother if/ whether she liked the dinner last night.   3. 当宾语从句是由特殊疑问句变化而来时,原句中的疑问词充当连接代词(如who, whose, what, which)或连接副词(如when, where, why, how),引导宾语从句。例如:   Do you know what we can do on the island?   I don"t know why Jane was late for school this morning.   三、高中宾语从句要点之语序的陈述化   宾语从句一般要用陈述句语序。例如:   When did he leave? I want to know. →I want to know when he left.   Does the shop close at six every day? Do you know? →Do you know if/ whether the shop closes at six every day?   四、高中宾语从句要点之否定转移   当主句的谓语动词为think, believe, suppose等动词,且主语为第一人称时,从句的否定要转移到主句上。例如:   I don"t believe he is here on time, is he?   I don"t think Tom is the best student in his class, is he?

《高中英语语法-名词性从句》由英语我整理,更多请访问:https://www.liuxue86.com/english/。本内容整理时间为05月12日,如有任何问题请联系我们。 名词性从句 名词性从句相当于名词,可分别作主句的主语、表语、宾语和同位语。因此,名词性从句厅分为主语从句、表语从句、宾语从句和同位从句。 (一)引导名词性从句的连接词 1、连接代词:who, whose, whom, what, which。有词义,在从句中担任成分,如主语、表语、宾语、或定语等。 2、连接副词:when, where, why, how。有词义,在从句中担任成分,作状语。 3、连接词:that, whether, if, as if。that 无词义,在从句中不担任成分,有时可省略;if (whether), as if虽有词义,但在从句中不担任成分。 注意:连接代词与连接副词在句中不再是疑问句,因而从句中谓语不用疑问式。连接代词与连接副词在从句充当句子成分,连接词whether 和if(是否),as if(好象)在从句中不充当句子成分,只起连接作用。根据句义,如果连接代词与连接副词,whether、if 和as if都用不上时,才用that作连接词(that本身无任何含义)。 (二)主语从句 1、主语从句在复合句作主语。 e.g. Who will go is not important. 2、用it作形式主语,主语从句放在句末。 e.g. It doesn"t matter so much whether you will come or not. 3、that引导主语从句时,不能省略。 e.g. That he suddenly fell ill last week made us surprised. (三)表语从句 1、表语从句在复合句中作表语,位于系动词之后。 e.g. The question was who could go there. 2、引导表语从句的连接词that有时可省去。 e.g. My idea is (that) we can get more comrades to help in the work. (四)宾语从句 1、宾语从句在复合句中作宾语。引导宾语从句的连词that一般可省略。 e.g. I hope (that) everything is all right. 2、介词之后的宾语从句,不可用which或if连接,要分别用what或 whether。 e.g. I"m interested in whether you"ve finished the work.. I"m interested in what you"ve said. 3、whether与if都可以引导宾语从句,常可互换。但下面情况不能互换。 ①宾语从句是否定句时,只用if,不用whether。 e.g. I wonder if it doesn"t rain. ②用if 会引起误解,就要用whether。 e.g. Please let me know whether you want to go.(此句如果把whether改成if,容易当成条件句理解) ③宾语从句中的whether 与or not直接连用,就不能换成if;不直接连用,可换。 e.g. I don"t know whether or not the report is true. I don"t know whether/ if the report is true or not. ④介词后的宾语从句要用whether引导。whether 可与不定式连用。whether也可引导主语从句、表语从句、同位语从句,还可引导让步状语从句,以上均不能换成if。但引导条件从句时,只能用if,而不能用whether。 e.g. It depends on whether we have enough time. 《历史文化名城名镇名村保护条例》   第一章 总  则   第一条 为了加强历史文化名城、名镇、名村的保护与管理,继承中华民族优秀历史文化遗产,制定本条例。   第二条 历史文化名城、名镇、名村的申报、批准、规划、保护,适用本条例。   第三条 历史文化名城、名镇、名村的保护应当遵循科学规划、严格保护的原则,保持和延续其传统格局和历史风貌,维护历史文化遗产的真实性和完整性,继承和弘扬中华民族优秀传统文化,正确处理经济社会发展和历史文化遗产保护的关系。   第四条 国家对历史文化名城、名镇、名村的保护给予必要的资金支持。   历史文化名城、名镇、名村所在地的县级以上地方人民政府,根据本地实际情况安排保护资金,列入本级财政预算。   国家鼓励企业、事业单位、社会团体和个人参与历史文化名城、名镇、名村的保护。   第五条 国务院建设主管部门会同国务院文物主管部门负责全国历史文化名城、名镇、名村的保护和监督管理工作。   地方各级人民政府负责本行政区域历史文化名城、名镇、名村的保护和监督管理工作。   第六条 县级以上人民政府及其有关部门对在历史文化名城、名镇、名村保护工作中做出突出贡献的单位和个人,按照国家有关规定给予表彰和奖励。   第二章 申报与批准   第七条 具备下列条件的城市、镇、村庄,可以申报历史文化名城、名镇、名村:   (一)保存文物特别丰富;   (二)历史建筑集中成片;   (三)保留着传统格局和历史风貌;   (四)历史上曾经作为政治、经济、文化、交通中心或者军事要地,或者发生过重要历史事件,或者其传统产业、历史上建设的重大工程对本地区的发展产生过重要影响,或者能够集中反映本地区建筑的文化特色、民族特色。   申报历史文化名城的,在所申报的历史文化名城保护范围内还应当有2个以上的历史文化街区。   第八条 申报历史文化名城、名镇、名村,应当提交所申报的历史文化名城、名镇、名村的下列材料:   (一)历史沿革、地方特色和历史文化价值的说明;   (二)传统格局和历史风貌的现状;   (三)保护范围;   (四)不可移动文物、历史建筑、历史文化街区的清单;   (五)保护工作情况、保护目标和保护要求。   第九条 申报历史文化名城,由省、自治区、直辖市人民政府提出申请,经国务院建设主管部门会同国务院文物主管部门组织有关部门、专家进行论证,提出审查意见,报国务院批准公布。   申报历史文化名镇、名村,由所在地县级人民政府提出申请,经省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门组织有关部门、专家进行论证,提出审查意见,报省、自治区、直辖市人民政府批准公布。   第十条 对符合本条例第七条规定的条件而没有申报历史文化名城的城市,国务院建设主管部门会同国务院文物主管部门可以向该城市所在地的省、自治区人民政府提出申报建议;仍不申报的,可以直接向国务院提出确定该城市为历史文化名城的建议。   对符合本条例第七条规定的条件而没有申报历史文化名镇、名村的镇、村庄,省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门可以向该镇、村庄所在地的县级人民政府提出申报建议;仍不申报的,可以直接向省、自治区、直辖市人民政府提出确定该镇、村庄为历史文化名镇、名村的建议。   第十一条 国务院建设主管部门会同国务院文物主管部门可以在已批准公布的历史文化名镇、名村中,严格按照国家有关评价标准,选择具有重大历史、艺术、科学价值的历史文化名镇、名村,经专家论证,确定为中国历史文化名镇、名村。   第十二条 已批准公布的历史文化名城、名镇、名村,因保护不力使其历史文化价值受到严重影响的,批准机关应当将其列入濒危名单,予以公布,并责成所在地城市、县人民政府限期采取补救措施,防止情况继续恶化,并完善保护制度,加强保护工作。   第三章 保护规划   第十三条 历史文化名城批准公布后,历史文化名城人民政府应当组织编制历史文化名城保护规划。   历史文化名镇、名村批准公布后,所在地县级人民政府应当组织编制历史文化名镇、名村保护规划。   保护规划应当自历史文化名城、名镇、名村批准公布之日起1年内编制完成。   第十四条 保护规划应当包括下列内容:   (一)保护原则、保护内容和保护范围;   (二)保护措施、开发强度和建设控制要求;   (三)传统格局和历史风貌保护要求;   (四)历史文化街区、名镇、名村的核心保护范围和建设控制地带;   (五)保护规划分期实施方案。   第十五条 历史文化名城、名镇保护规划的规划期限应当与城市、镇总体规划的规划期限相一致;历史文化名村保护规划的规划期限应当与村庄规划的规划期限相一致。   第十六条 保护规划报送审批前,保护规划的组织编制机关应当广泛征求有关部门、专家和公众的意见;必要时,可以举行听证。   保护规划报送审批文件中应当附具意见采纳情况及理由;经听证的,还应当附具听证笔录。   第十七条 保护规划由省、自治区、直辖市人民政府审批。   保护规划的组织编制机关应当将经依法批准的历史文化名城保护规划和中国历史文化名镇、名村保护规划,报国务院建设主管部门和国务院文物主管部门备案。   第十八条 保护规划的组织编制机关应当及时公布经依法批准的保护规划。   第十九条 经依法批准的保护规划,不得擅自修改;确需修改的,保护规划的组织编制机关应当向原审批机关提出专题报告,经同意后,方可编制修改方案。修改后的保护规划,应当按照原审批程序报送审批。   第二十条 国务院建设主管部门会同国务院文物主管部门应当加强对保护规划实施情况的监督检查。   县级以上地方人民政府应当加强对本行政区域保护规划实施情况的监督检查,并对历史文化名城、名镇、名村保护状况进行评估;对发现的问题,应当及时纠正、处理。   第四章 保护措施   第二十一条 历史文化名城、名镇、名村应当整体保护,保持传统格局、历史风貌和空间尺度,不得改变与其相互依存的自然景观和环境。   第二十二条 历史文化名城、名镇、名村所在地县级以上地方人民政府应当根据当地经济社会发展水平,按照保护规划,控制历史文化名城、名镇、名村的人口数量,改善历史文化名城、名镇、名村的基础设施、公共服务设施和居住环境。   第二十三条 在历史文化名城、名镇、名村保护范围内从事建设活动,应当符合保护规划的要求,不得损害历史文化遗产的真实性和完整性,不得对其传统格局和历史风貌构成破坏性影响。   第二十四条 在历史文化名城、名镇、名村保护范围内禁止进行下列活动:   (一)开山、采石、开矿等破坏传统格局和历史风貌的活动;   (二)占用保护规划确定保留的园林绿地、河湖水系、道路等;   (三)修建生产、储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的工厂、仓库等;   (四)在历史建筑上刻划、涂污。   第二十五条 在历史文化名城、名镇、名村保护范围内进行下列活动,应当保护其传统格局、历史风貌和历史建筑;制订保护方案,经城市、县人民政府城乡规划主管部门会同同级文物主管部门批准,并依照有关法律、法规的规定办理相关手续:   (一)改变园林绿地、河湖水系等自然状态的活动;   (二)在核心保护范围内进行影视摄制、举办大型群众性活动;   (三)其他影响传统格局、历史风貌或者历史建筑的活动。   第二十六条 历史文化街区、名镇、名村建设控制地带内的新建建筑物、构筑物,应当符合保护规划确定的建设控制要求。   第二十七条 对历史文化街区、名镇、名村核心保护范围内的建筑物、构筑物,应当区分不同情况,采取相应措施,实行分类保护。   历史文化街区、名镇、名村核心保护范围内的历史建筑,应当保持原有的高度、体量、外观形象及色彩等。   第二十八条 在历史文化街区、名镇、名村核心保护范围内,不得进行新建、扩建活动。但是,新建、扩建必要的基础设施和公共服务设施除外。   在历史文化街区、名镇、名村核心保护范围内,新建、扩建必要的基础设施和公共服务设施的,城市、县人民政府城乡规划主管部门核发建设工程规划许可证、乡村建设规划许可证前,应当征求同级文物主管部门的意见。   在历史文化街区、名镇、名村核心保护范围内,拆除历史建筑以外的建筑物、构筑物或者其他设施的,应当经城市、县人民政府城乡规划主管部门会同同级文物主管部门批准。   第二十九条 审批本条例第二十八条规定的建设活动,审批机关应当组织专家论证,并将审批事项予以公示,征求公众意见,告知利害关系人有要求举行听证的权利。公示时间不得少于20日。   利害关系人要求听证的,应当在公示期间提出,审批机关应当在公示期满后及时举行听证。   第三十条 城市、县人民政府应当在历史文化街区、名镇、名村核心保护范围的主要出入口设置标志牌。   任何单位和个人不得擅自设置、移动、涂改或者损毁标志牌。   第三十一条 历史文化街区、名镇、名村核心保护范围内的消防设施、消防通道,应当按照有关的消防技术标准和规范设置。确因历史文化街区、名镇、名村的保护需要,无法按照标准和规范设置的,由城市、县人民政府公安机关消防机构会同同级城乡规划主管部门制订相应的防火安全保障方案。   第三十二条 城市、县人民政府应当对历史建筑设置保护标志,建立历史建筑档案。   历史建筑档案应当包括下列内容:   (一)建筑艺术特征、历史特征、建设年代及稀有程度;   (二)建筑的有关技术资料;   (三)建筑的使用现状和权属变化情况;   (四)建筑的修缮、装饰装修过程中形成的文字、图纸、图片、影像等资料;   (五)建筑的测绘信息记录和相关资料。   第三十三条 历史建筑的所有权人应当按照保护规划的要求,负责历史建筑的维护和修缮。   县级以上地方人民政府可以从保护资金中对历史建筑的维护和修缮给予补助。   历史建筑有损毁危险,所有权人不具备维护和修缮能力的,当地人民政府应当采取措施进行保护。   任何单位或者个人不得损坏或者擅自迁移、拆除历史建筑。   第三十四条 建设工程选址,应当尽可能避开历史建筑;因特殊情况不能避开的,应当尽可能实施原址保护。   对历史建筑实施原址保护的,建设单位应当事先确定保护措施,报城市、县人民政府城乡规划主管部门会同同级文物主管部门批准。   因公共利益需要进行建设活动,对历史建筑无法实施原址保护、必须迁移异地保护或者拆除的,应当由城市、县人民政府城乡规划主管部门会同同级文物主管部门,报省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门批准。   本条规定的历史建筑原址保护、迁移、拆除所需费用,由建设单位列入建设工程预算。   第三十五条 对历史建筑进行外部修缮装饰、添加设施以及改变历史建筑的结构或者使用性质的,应当经城市、县人民政府城乡规划主管部门会同同级文物主管部门批准,并依照有关法律、法规的规定办理相关手续。   第三十六条 在历史文化名城、名镇、名村保护范围内涉及文物保护的,应当执行文物保护法律、法规的规定。   第五章 法律责任   第三十七条 违反本条例规定,国务院建设主管部门、国务院文物主管部门和县级以上地方人民政府及其有关主管部门的工作人员,不履行监督管理职责,发现违法行为不予查处或者有其他滥用职权、玩忽职守、徇私舞弊行为,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,依法给予处分。   第三十八条 违反本条例规定,地方人民政府有下列行为之一的,由上级人民政府责令改正,对直接负责的主管人员和其他直接责任人员,依法给予处分:   (一)未组织编制保护规划的;   (二)未按照法定程序组织编制保护规划的;   (三)擅自修改保护规划的;   (四)未将批准的保护规划予以公布的。   第三十九条 违反本条例规定,省、自治区、直辖市人民政府确定的保护主管部门或者城市、县人民政府城乡规划主管部门,未按照保护规划的要求或者未按照法定程序履行本条例第二十五条、第二十八条、第三十四条、第三十五条规定的审批职责的,由本级人民政府或者上级人民政府有关部门责令改正,通报批评;对直接负责的主管人员和其他直接责任人员,依法给予处分。   第四十条 违反本条例规定,城市、县人民政府因保护不力,导致已批准公布的历史文化名城、名镇、名村被列入濒危名单的,由上级人民政府通报批评;对直接负责的主管人员和其他直接责任人员,依法给予处分。   第四十一条 违反本条例规定,在历史文化名城、名镇、名村保护范围内有下列行为之一的,由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施;有违法所得的,没收违法所得;逾期不恢复原状或者不采取其他补救措施的,城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施,所需费用由违法者承担;造成严重后果的,对单位并处50万元以上100万元以下的罚款,对个人并处5万元以上10万元以下的罚款;造成损失的,依法承担赔偿责任:   (一)开山、采石、开矿等破坏传统格局和历史风貌的;   (二)占用保护规划确定保留的园林绿地、河湖水系、道路等的;   (三)修建生产、储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的工厂、仓库等的。   第四十二条 违反本条例规定,在历史建筑上刻划、涂污的,由城市、县人民政府城乡规划主管部门责令恢复原状或者采取其他补救措施,处50元的罚款。   第四十三条 违反本条例规定,未经城乡规划主管部门会同同级文物主管部门批准,有下列行为之一的,由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施;有违法所得的,没收违法所得;逾期不恢复原状或者不采取其他补救措施的,城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施,所需费用由违法者承担;造成严重后果的,对单位并处5万元以上10万元以下的罚款,对个人并处1万元以上5万元以下的罚款;造成损失的,依法承担赔偿责任:   (一)改变园林绿地、河湖水系等自然状态的;   (二)进行影视摄制、举办大型群众性活动的;   (三)拆除历史建筑以外的建筑物、构筑物或者其他设施的;   (四)对历史建筑进行外部修缮装饰、添加设施以及改变历史建筑的结构或者使用性质的;   (五)其他影响传统格局、历史风貌或者历史建筑的。   有关单位或者个人经批准进行上述活动,但是在活动过程中对传统格局、历史风貌或者历史建筑构成破坏性影响的,依照本条第一款规定予以处罚。   第四十四条 违反本条例规定,损坏或者擅自迁移、拆除历史建筑的,由城市、县人民政府城乡规划主管部门责令停止违法行为、限期恢复原状或者采取其他补救措施;有违法所得的,没收违法所得;逾期不恢复原状或者不采取其他补救措施的,城乡规划主管部门可以指定有能力的单位代为恢复原状或者采取其他补救措施,所需费用由违法者承担;造成严重后果的,对单位并处20万元以上50万元以下的罚款,对个人并处10万元以上20万元以下的罚款;造成损失的,依法承担赔偿责任。   第四十五条 违反本条例规定,擅自设置、移动、涂改或者损毁历史文化街区、名镇、名村标志牌的,由城市、县人民政府城乡规划主管部门责令限期改正;逾期不改正的,对单位处1万元以上5万元以下的罚款,对个人处1000元以上1万元以下的罚款。   第四十六条 违反本条例规定,对历史文化名城、名镇、名村中的文物造成损毁的,依照文物保护法律、法规的规定给予处罚;构成犯罪的,依法追究刑事责任。   第六章 附  则   第四十七条 本条例下列用语的含义:   (一)历史建筑,是指经城市、县人民政府确定公布的具有一定保护价值,能够反映历史风貌和地方特色,未公布为文物保护单位,也未登记为不可移动文物的建筑物、构筑物。   (二)历史文化街区,是指经省、自治区、直辖市人民政府核定公布的保存文物特别丰富、历史建筑集中成片、能够较完整和真实地体现传统格局和历史风貌,并具有一定规模的区域。   历史文化街区保护的具体实施办法,由国务院建设主管部门会同国务院文物主管部门制定。   第四十八条 本条例自2008年7月1日起施行。
